1. Who we are

This website is operated by Starc Ecom B.V., registered in the Netherlands, KvK 91371716, VAT NL865633617B01, at Radarweg 29, 1043 NX Amsterdam. Fifth Avenue Label is a trading name of Starc Ecom B.V. Any contract you enter into through this site is with Starc Ecom B.V.

References to we, us and our mean Starc Ecom B.V.

2. Where our goods come from

Our garments are manufactured by our production partners in the People's Republic of China and are dispatched to you from there. All US import duties are paid by us before your parcel enters the United States.

3. Eligibility

You must be at least 18, or the age of majority in your state, to place an order. By ordering you confirm that you are.

4. Orders

Your order is an offer to buy. Our confirmation email acknowledges receipt. The contract is formed when we dispatch the goods. We may refuse or cancel any order, including after confirmation, where the item is unavailable, the price or description was wrong, or we suspect fraud or unauthorised use of a payment method. Where we cancel a paid order, we refund in full.

5. Prices

Prices are in US dollars and include US import duties. Prices exclude any applicable sales tax, which is shown separately at checkout where it applies. We may change prices at any time, but never after you have placed an order.

6. Delivery

Delivery times are set out in our Shipping Policy and are estimates, not guarantees. Where we cannot ship within 30 days of your order, we will contact you with a choice between a revised date and a full refund.

Risk in the goods passes to you on delivery.

7. Returns

Your rights and the process are set out in our Returns and Refunds Policy, which forms part of these terms. Returns travel to our partner facility in the People's Republic of China at your cost. Faulty, damaged and incorrect items are resolved at our cost and do not need to be returned.

8. Product descriptions and colour

We describe our products as accurately as we can. Colours vary between screens and between production batches, and measurements may vary by up to [2 cm] because garments are cut by hand. Minor variation of this kind is not a fault.

9. Intellectual property

All content on this site, including text, photographs, graphics and the Fifth Avenue Label name and logo, belongs to Starc Ecom B.V. or its licensors. You may not reproduce or use it commercially without our written permission.

10. Acceptable use

You may not use this site unlawfully, attempt to gain unauthorised access to it, place orders using another person's payment method, or place orders for resale without our written agreement.

11. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss.

12. Governing law and jurisdiction

These terms are governed by the laws of the Netherlands, and the courts of Amsterdam have jurisdiction over any dispute.

This does not deprive you of the protection of any mandatory consumer law of the state in which you live, where that law cannot be excluded by agreement.
